This enabled Priestly to say things about the future. J B Priestly wrote this play as he saw an urgent need for social change and used the play to express his desire for social equality. This play makes us aware of what has happened and learn from mistakes made. Priestly hoped his play would give society the chance with hindsight to look back on the past and not just carry on life in the same way as before. Priestly took full advantage of writing in hindsight and makes sure that it will make the audience realise how wrong they may have been in assuming future events. The play is set in an industrial city in the Midlands of 1917 and concerns a wealthy industrial Arthur Birling, his family, his daughters fianci Gerald Croft and an Inspector. It shows how the family each help to destroy a young womans life-Eva Smith through their selfish and callous attitudes which results in her death. The play runs parallel to what was happening to society at the time. Each uncaring action or statement is backed up with ensuing consequences. The play opens with a conversation between Mr. Birling and family and Gerald Croft. The family is sitting in their living room celebrating the success of their daughters engagement to the son of a businessman of similar status as the Birling family. The inspector is the catalyst for the events of the play. He makes us realise the Birling familys responsibilities. He makes the characters and audience realise that everything we do has a consequence and that we must think about our actions. He guides the audience through the play and creates tension and revelations. Was it murder or suicide? J. B. Priestlys An Inspector Calls is a tragic play about a girl named Eva Smith who died in a forced suicide, but who was responsible? There where many people in Evas life that treated her unfairly. Each person pushed her closer to suicide, but no one person was solely responsible for her death. Whether one person deserves to take more of the blame than another is difficult to say. In my opinion, three people stand out and seem the most responsible. These people are Mr. Birling, Gerald and Sheila Birling. These people all treated Eva unfairly and are all partly responsible for her death. We must remember that these three people are not responsible for any actual crime but they all contributed to the downfall of a particular person due to their attitudes and beliefs. Mr. Birling was the first to have contact with Eva and I believe he started the string of unfortunate events that ultimately led to the death of Eva Smith. He hired Eva at his works and not long after, he fired her. Eva was unsatisfied with her wage of twenty-two shillings and a sixpence so she started a strike demanding a wage of only twenty-five shillings. Mr. Birling refused and without a second of consideration for Eva, he fired her. Mr. Birling was very ignorant and this ignorance convinced him he was right. When he was asked why he fired Eva, he answered, Well, its my duty to keep labour costs down, and if Id agreed to this demand for a new rate wed have added about twelve per cent to our labour costs. (Act one page 15 lines 8-10) Mr. Birling failed to see any wrong in his actions and refused to accept responsibility. When told of the consequences of his actions, that Eva was out of work for two months and desperate for money, Mr. Birling showed no remorse. He explained that, The girl had been causing trouble in the works. I was quite justified (Act one page 17 lines 28-29) Mr. Birling always seems to want his own way and when he does not get it he resorts to threatening behavior which clearly would make him unpopular with the audience. When Mr. Birling felt that the Inspector was asking too many questions Mr. Birling says about the chief constable, Perhaps I ought to warn you that he is an old friend of mine. Even before the Inspector had arrived we see Mr. Birling in an unfavorable light. For example in an attempt to be intellectual he says things that we now know to be completely untrue such as describing the Titanic as Completely unsinkable and saying The Germans dont want war. Mr. Birling is a cold, selfish and ignorant man. His selfish behavior drove Eva to suicide, but in his selfish eyes, he sees no wrong. Sheila was also partly to blame, but to what extent? It seems that Sheila played a very small part in Evas death, but in my opinion this is not the case. She wrongfully used her position as an important customer to turn Eva out of a job. This was undoubtedly a major factor in Evas death. She even admits, it was my own fault, and that she was in a furious temper She was jealous of Eva describing her as a very pretty girl too with big dark eyes. Although her actions show her to be a bad tempered, jealous and malicious person, you get the impression as she begins to talk that that is quite a harsh view of her and that although she does have bad characteristics, she isnt really as bad as you first think her to be. She shows herself to be honest admitting straight away all that she had done, that she caught sight of her smiling at the assistant and I was furious with her. Sheila does show empathy for Eva which is more than her father, Mr. Birling did. It is obvious that she does regret all that she had done with regard to Eva claiming that, If I could help her now I would. Sheila comes across as very remorseful as she says I felt rotten about it at the time and now I feel a lot worse. She bitterly resents what she did as well promising that Ill never, never do it again. This makes you feel less anger for Sheila who now feels immense guilt and has now been punished severely simply by knowing the implications her temper and jealousy had. Sheila was undoubtedly partly responsible but she has the decency to admit this. Unlike her father, Mr. Birling, she regrets her actions and feels immense guilt.

Among the rest, Python, an enormous serpent, crept forth, the terror of the people, and lurked in the caves of Mount Parnassus. Apollo slew him with his arrows - weapons which he had not before used against any but feeble animals, hares, wild goats, and such game. In commemoration of this illustrious conquest he instituted the Pythian games, in which the victor in feats of strength, swiftness of foot, or in the chariot race was crowned with a wreath of beech leaves; for the laurel was not yet adopted by Apollo as his own tree. The famous statue of Apollo called the Belvedere represents the god after this victory over the serpent Python. He touched the stem, and felt the flesh tremble under the new bark. He embraced the branches, and lavished kisses on the wood. The branches shrank from his lips. Since you cannot be my wife, said he, you shall assuredly be my tree. I will wear you for my crown; I will decorate with you my harp and my quiver; and when the great Roman conquerors lead up the triumphal pomp to the Capitol, you shall be woven into wreaths for their brows. And, as eternal youth is mine, you also shall be always green, and your leaf know no decay. The nymph, now changed into a Laurel tree, bowed its head in grateful acknowledgment. That Apollo should be the god both of music and poetry will not appear strange, but that medicine should also be assigned to his province, may. The poet Armstrong, himself a physician, thus accounts for it: Music exalts each joy, allays each grief,Expels diseases, softens every pain;And hence the wise of ancient days adoredOne power of physic, melody, and song. The story of Apollo and Daphne is of ten alluded to by the poets. Waller applies it to the case of one whose amatory verses, though they did not soften the heart of his mistress, yet won for the poet wide-spread fame: Yet what he sung in his immortal strain,Though unsuccessful, was not sung in vain.All but the nymph that should redress his wrong,Attend his passion and approve his song.Like Phoebus thus, acquiring unsought praise,He caught at love and filled his arms with bays. Social need is the third stage in this Maslow’s hierarchy of needs theory. Individuals try to achieve social recognition within this stage. In terms of a workplace, an employee tries to achieve social recognition from their sub-ordinates and colleagues. ... It can enhance the performance of the employees. According to Frederic Herzberg, the individual needs of a people should be satisfied within an organization. According to this theory, there are two influences or degrees that can affect the level of perception of an individual within the workplace of a company. Motivators or satisfiers and hygiene factors or dissatisfiers are considered as specific influences. Nature of work is an important motivation driver. Several positive aspects can fulfill the job satisfaction of an employee (Wood, Zeffane, Fromholtz, Wiesner, Morrison & Seet, 2013). Achievement of career objectives, social recognition within workplace, job promotion, potential opportunity for individual development within organization and level of responsibili ty are considered as the motivating factors that can enhance the efficiency and performance level of an employee. On the other hand, several hygiene or dissatisfiers factors can upset employees. It has several negative consequences on the business productivity of an organization. Inadequate workplace environment, poor developed policy and unjustified salary distribution can be considered as the dissatisfiers factors. Poor organizational policy can affect the motivation and performance level of an employee (Baldonado, 2008). Unfortunately, it is observation that Indonesian contemporary art confronts misinterpretation as outsiders do not know the current situation in Indonesia, or that their knowledge on Indone sia is not up-to-date, hence, failing to understand the symbolism, perspective, and scope that the artwork entails. In short, taking consideration of not being present, the artwork becomes insignificant and loses integrity of its history. What one comprehends as the real identity of Indonesian art is in fact comes with various confrontations and misapplications, which eventually become difficult to be handled constructively. This movie shows the realization of the American Dream. A family empire built from little to nothing. Though the business that took place in this movie was certainly illegitimate, the practices and rules they lived by are a key asset to modern day business. Break the laws they might, but family values are one of the most scared attributes to being part of these families. The Godfather truly shows it’s important to play by the rules, or you’ll be â€Å"sleeping with the fishes†. There are plenty of great lines in this movie in which hold great value in business. â€Å"Never dishonor those who help you†. Taking care of those who take care of you, great businesses today understand the importance of this. They take care of employees that contribute well to the company and partnerships that generate business. â€Å"Don’t discuss business at the dinner table†. This is a great line for people in business to understand. This means there is a proper time and place for business talk. And in my opinion, one of the most well-known lines, â€Å"It’s not personal, it’s business†. It’s very important in business to understand that your business life and personal life are separate, and that the main goal of a business is to make money. Competitors will get beat and will not be happy about it, but it’s not personal, it’s business. Business is not all about making people happy but is more so about making the business money. That being said, many of the other values of business both in The Godfather and in the business world are kept in check with the values that are set. Defying those values can prove to be very costly as illustrated in the movie. The Godfather shows how doing business properly is vital to the old world values that are set. To be respectful and understand your priorities, as stated, â€Å"A man who doesn’t spend time with his family can never be a real man†. The movie shows that in business it is vitally important how we conduct ourselves, how we interact with others, and how we stand behind the team, or family, that we are a part of and not deceive them. â€Å"Show, don’t tell†. This has means that there is more credibility in what you do, not just what you say. You can’t say that you conduct yourself following the values that are set by your peers; your actions have to speak for themselves. Though in The Godfather, much of the business conducted had plenty of corruption, violence, and vengeance, there was still a very strong set of values on how the different families conducted themselves in their business dealings. This goes to show how ethics is something that can be interpreted differently. Something that might be considered unethical and wrong to one person might be considered perfectly fine and ethically sound to another. It’s interesting how the strong family values were of the utmost importance, even though they were involved in illegitimate business. This movie really illustrates the importance to take pride in your work and to play by the rules. Loyalty is, in my opinion, one of the biggest lessons The Godfather shows. Being loyal you your family or business is essential to them doing just that for you, but defy them and you will have a mark against you by them and others who know that you are not a loyal member. Being loyal is so important in business. It’s taught to us at a young age, â€Å"treat others the way you would want to be treated†. The movie emphasizes this greatly, as family is the most important thing, and since the family is in business together, business loyalty is even more important. The Beast Within The spawn knelt in the shadows of the corner. His iridescent eyes searching the dark for his prey. A prey he knew very well, almost too well. From the end of the stone corridor the spawn's ear picked out a single disturbance. From behind the mask a man's mouth twisted in a smile and a thought of satisfaction crossed his mind. Rising to his feet the spawn walked defiantly down the corridor. His armoured boots making no sound on the cold floor. A heart that beat no blood, pounded within the unnatural armour of the spawn. At last his mission was drawing to a close and so too would this endless torture. The one being responsible for his spawning would now ultimately reach its death. The door was close now, and the spawn's soulless eyes peered into the room from the doors barred window. Standing over a bench stood a man. An old man, gnarled with age and working on an intricate machine. To a mortal man the sight would appear ludicrous. An old, befuddled man could hardly attract the attention of such a powerful warrior. But to the spawns eyes, he only saw the truth. He didn't see the lines of age which covered the man's face. Nor did he see the disfigured spine which pushed the man's back into a painful composure. But he did see the beast within. To the spawn, what stood in the other room had no dimensions, it glittered with a warrior's sweat and had an evil which protruded off its hide like poisonous spines. This creature had roamed the aeons sending multitudes of innocent 'children' to nothingness before their time. In ages past it was known as Ra, god of the sun, then it was known as Xeues. Only a thousand years ago they called him a Dragon, and now, he was known as a scientist. Figure heads for the world, able to control the elements to their wishes. But today, it was time for the creature to end its cultivation of evil on earth. One man who the beast had killed had refused to die. By sheer power of will he had re-spawned to become the 'Spawn', and now, after centuries of silent following had finally decided that enough was enough! Kicking open the barred door the Spawn raised his hell blade in a warriors salute and cried, "Your time is up beast! Never again will you commit crimes against humanity! The writer can be autocratic, charismatic, bureaucratic, and democratic. Autocratic comes involved when depended on thoughts and reactions without someone else’s supervision, whereas, using personality and charm as a charismatic leader to get people to do the task without using force, and bureaucratic shows when needed to rely on the guidelines and rules in certain times such as safety prevention. However, democratic should be a part of everyone’s style, especially if he or she is working with other team members. Culture According to Kroeber and Kluckholn (1952) culture consists of patterns, explicit and implicit, of and for behaviour acquired and transmitted by symbols, constituting the distinctive achievement of human groups, including their embodiment in artifacts. Sinha (2000) suggests that â€Å"Culture consists of totality of assumptions, beliefs, values, social systems and institutions, physical artifacts and behaviour of people, reflecting their desire to maintain continuity as well as to adapt to external demands.† Organisational Culture Organisational culture is a system of shared meaning held by members that distinguishes an organisation from other organisations. Organisational culture is the set of values that helps the organisation’s employees understanding which actions are considered acceptable and which are unacceptable According to Schein, Organisational Culture is defined as A pattern of shared basic assumptions that the group learned as it solved its problems of external adaptation and internal integration, that has worked well enough to be considered valid and, therefore, to be taught to new members as a correct way to perceive, think and feel in relation to those problems Gareth Morgan has described organizational culture as: â€Å"The set of the set of beliefs, values, and norms, together with symbols like dramatized events and personalities, that represents the unique character of an organization, and provides the context for action in it and by it.† Types of Organizational Culture Organisational culture can vary in a number of ways. It is these variances that differentiate one organisation from the others. Some of the bases of the differentiation are presented below : 1. Strong vs weak culture : Organisational culture can be labelled as strong or weak based on sharedness of the core values among organisational members and the degree of commitment the members have to these core values. The higher the sharedness and commitment, the stronger the culture increases the possibility of behaviour consistency amongst its members, while a weak culture opens avenues for each one of the members showing concerns unique to themselves. 2. Soft vs hard culture : Soft work culture can emerge in an organisation where the organisation pursues multiple and conflicting goals. In a soft culture the employees choose to pursue a few objectives which serve personal or sectional interests. A typical example of soft culture can be found in a number of public sector organisations in India where the management feels constrained to take action against employees to maintain high productivity. The culture is welfare oriented; people are held accountable for their mistakes but are not rewarded for good performance. Consequently, the employees consider work to be less important than personal and social obligations. Sinha (1990) has presented a case study of a public sector fertilizer company which was established in an industrially backward rural area to promote employment generation and industrial activity. Under pressure from local communities and the government, the company succumbed to overstaffing, converting mechanised operations into manual operations, payment of overtime, and poor discipline. This resulted in huge financial losses (up to 60 percent of the capital) to the company. 3. Formal vs informal culture : The work culture of an organisation, to a large extent, is influenced by the formal components of organisational culture. Roles, responsibilities, accountability, rules and regulations are components of formal culture. They set the expectations that the organisation has from every member and indicates the consequences if these expectations are not fulfilled. Mechanistic and organic cultures: The most important aspects of organisation in public sector companies include hierarchies, supervision, control, formalisation, flow of authority and communication from top to bottom, etc., rather than the results or outcome. Organisations with these characters are termed as mechanistic organisations. They follow status quo strategy and therefore resist innovation and aggressiveness on the part of employees. These organisations also lack customer-orientation and employee welfare. Tata Infotech, on the other hand, is more flexible and open. Jobs and roles are not defined rigidly and employees are given freedom to adjust themselves to the environmental requirement. Concern is more towards the outcome and results, but not the procedure or hierarchy. Communication in this company is more multi-directional. The informal communication is widely used. Decision-making is more decentralized. People with the ability to handle problems are given freedom to assume authority and responsibility. This company is a continuous learning organisation from the environment and such companies are termed as organic structures.† The mechanic culture de-motivates the competent people and leads to negative organisational culture and while the organic culture motivate the able employees to be competitive and innovative. Authoritarian and participative cultures: Authority to make the decisions is centralised at the top management level in Nagarjuna Fertilisers Limited. Consequently, the CEO of the company makes the decisions and informs them to the lower levels in the organisation. Such culture of concentration of authority and power at the central level is called authoritarian culture. Such a culture kills the initiative and innovativeness of the employees at different levels. In contrast, Cybertech Systems and Software decentralises the power and authority decision-making. In fact, employees are involved in decision-making. Communication flows not only from the top to bottom but also from the bottom to the top. Such type of culture is called participative culture. Participative culture encourages the employees to be innovative, aggressive and to take risks. Features of Organisational Culture The analysis of the above definitions indicate the following features of organisational culture Innovation and risk taking: ‘Innovation is the way of life in Microsoft.’ Innovation the key characteristic of Gillette Company.’ Companies encourage the employees to innovative and risk takers at different degrees. Attention to detail: ‘Employees in the Boston Consultancy Group are expected to be precise, analytical and pay attention to even the minor details.’ Thus, organisations require their employees to be precise, analytical and pay attention to the minute details at different degrees. Outcome orientation: ‘Coromandal Cements expects its employees to improve their performance at least by 5% every year irrespective of the approaches they follow.’ Thus the organisations require their employees to pay attention or the results. Pople Orientation: Hewlett and Packard announced one day unpaid holiday for every nine working days and avoided lay-off.’ Thus, the organisations take the effect its decisions on the employees.ei Team orientation: â€Å"Global Solutions repeats: â€Å"We Work.† It does mean that activities are designed around teams but not individuals. Thus, we today find team jobs rather than individual jobs. Aggressiveness: The employees of State Bank of India were not allowed to be aggressive whereas the employees of IDBI Bank are expected to be aggressive and competitive. Thus, aggressiveness is the level to which the employees are expected to be competitive rather than easygoing. Stability: Most of the Indian Universities still have the status quo strategy of maintaining the traditional values and beliefs of ‘Guru and Shishya’ parampara of Gurukulas Radical change: In contrast to the stability strategy, most of the organisations after 1991 have the growth, diversification and conglomerate diversification strategies. It is the degree at which the organisational activities emphasise growth and diversification Customer Orientation: Pizza Huts build relationship with the customers and then adapt aggressive marketing strategies. Can We Actually Rewrite a Film The term â€Å"rewrite† by definition is to write something again. Its purpose is to correct or improve a piece of writing or a written document. In the academic world, rewriting a piece of document is to write it in a different manner, alter its form and make it concise, amend or carry out necessary improvements. Hashtag: #RewriteAFilmIn5Words Rewrite Is Not Limited to Piece of Writing The term â€Å"rewrite† by definition is to write something again. Its purpose is to correct or improve a piece of writing or a written document. In the academic world, rewriting a piece of document is to write it in a different manner, alter its form and make it concise, amend or carry out necessary improvements. However, is this definition and academic form of â€Å"rewrite† applicable to film? LEARNING MORAL VALUES IN COLLEGE MOVIES In reality, the difference between a film and piece of writing such as books, articles, essays, and other written documents is their form. Films and written documents are actually mediums of communication where authors can transmit ideas to the audience. Moreover, if one would look closely, a film (except actual footage of real-life events of course) is nothing but a visual representation of a written story, images of scripted events, and ideas delivered in an explicit and more understandable form. The advantage, however, is that unlike paperbacks, films leaves nothing to the imagination and therefore complete and more accurate in terms audience comprehension. Therefore, when someone says #RewriteAFilmIn5Words, the person is actually asking you to write a concise five words description of the written ideas successfully transmitted by the film you saw. Now, how would you do that? Since the understanding of ideas transmitted through a film is highly dependent on viewer’s (reader’s for paperbacks) recall and interpretation, slight variation in the rewritten text is expected. However, the rewritten text must reflect the main ideas and objectives of the film otherwise; it is nothing but a deceptive piece of writing. Rewriting Is an Exact Science Rewriting a film is no different from rewriting an article, essay, and other written documents you read and understood. However, rewriting a concise version of an original document or film requires skills or the ability to restructure and write it in your own words without spoiling its main ideas and  objectives. If one would rewrite this article in 10 words, for example, the rewritten text will be something like â€Å"rewriting a film is possible but it must be exact†. Similarly, five words rewrite of the 1994 film â€Å"Shawshank Redemption† should be something like â€Å"Inmates redeemed through mutual respect† rather than simply â€Å"I have a black friend†. The reason is that although the film is undeniably about true friendship, the film’s main idea, and the objective is much more than having a black friend. In fact, the film is sharing some ideas regarding the possibility of imprisonment regardless of innocence, education, and color, friendship between men can flourish through mutual respect, the power of education and knowledge in reducing difficulties in life, the effect of long incarceration on the ability of ex-convicts to start a new life, and others. If there is no word limit, then the rewritten text for this film will be longer, detailed, and precise. WHAT IS THE WORST SONG IN THE WORLD? A film rewrite should be accurate and like a piece of writing, the rewritten text should be different in form, improved, concise but communicating similar ideas and achieving the same objectives as the original work. In practice, rewriting academic text requires a thorough knowledge of the original work, paper formatting, and content restructuring, paraphrasing technique, different writing styles, consistency, and precision. ANIMAL WELFARE BOARD OF INDIA V A.NAGARAJA & ORS â€Å"Whenever there is a conflict between the customs and the law, there are two outcomes of the conflict. One is where the law changes the custom and society and the other is when the customs and society change the law†. The purpose of making a case commentary on this particular case is due to the after-effects of the postponement of the judgment on the public of south India and to study the relevance and compatibility of the judgment. The paper also aims in providing an alternative Even though I stand by and support several viewpoints of the courts, I still consider it would be better for the court to have gone through a harmonious approach. The judgment was solely based on the exhibits submitted by the councils and the previous. I have briefly explained the obnoxious reactions from the public towards the judgment and the order of the government in this paper. According to my observations, the viewpoint of the government hasn’t been noted enough rather the validation of the Acts and Orders were widely concentrated. The court was being too much stringent on the previous judgment in such a way that it fails to consider the sentimental feelings of the society and the benefits to them thereof. Hence there were certain curable flows on part of the court though the judgment cannot be said has completely irrelevant. India is a country with vast divergence, culture, customs and practices which has a direct influence on the eco-system. Though these customs are sources of law many of the customs cannot be in conformity with the statute. The legislature and judiciary take steps in eradicating such practices from the society. The judgment has proved to be a milestone in the perseverance of culture and the safety of the animals. The issues in consideration of the case include one, challenging the Madras High Court judgment on validating the Tamil Nadu Regulation of Jallikattu Act (hereafter TNRJ Act) and the other, challenging the Bombay High Court Judgement validating the 2011 notification whereby bulls were added in the prohibitory list of performing animals. Jallikattu and Rekla race is represented as a sport for bravery which uses trained bulls and participants. These bulls are subjected to immense cruelty before sending them through the entrance which leads to their violent behavior on the playground. The deaths and injuries during the game show its unhealthy nature. Thus Madras High Court in 2006 banned the practice of Jallikattu and rekla racing, which was upheld by the Supreme Court bench headed by Justice K.S. Radakrishnan in this case. An interim orders were passed by the court since till 2014 permitting both the sports, until the judgement which strictly banned the sports and held that the rights guaranteed under Sections 3 and 11 of Prevention of Cruelty to Animals (hereafter PCA Act) and Articles 51A (g) (h) cannot be curtailed, except for procedures laid down under Sections 22 of PCA Act, and instructed the government to protect and safeguard the freedoms of animals. After the TNRJ Act came into force, the Act was challenged under Art 32 of the constitution. Where the Supreme Court set aside the judgment of the Madras High Court which validated the Amended TNRJ Act, 2009 and held the Act as unconstitutional and violative to PCA Act and upheld the judgment of Bombay High Court which validated the Ministry of Environment and Forest (hereafter MoEF) notification of 2011 including bulls in the list of animals prohibited from being trained. PARTIES: In the initial petition i.e., in the writ of Mandamus filed under Art.226 of Indian Constitution, against Deputy Superintendent of Police of 2006, the parties were 1. Petitioner: K. Muniasamy Thevar, then vice-president of Karisalkulam panchayat for whom L. Shaji Chellan appeared before the court 2. Respondent: Deputy Superintend of Police for whom Government Advocate J. Viswanathan appeared The judgment was held by Madras High court bench headed by Justice R. Banumathi and Pinki Chandra Ghose. Later on, in 2014 in the SLP of Animal welfare board vs. A Nagaraja other (2014) 7 SCC 547 the parties were 1. Petitioner or Appellants: Animal Welfare Board of India (hereafter AWBI) and People for Ethical Treatment for Animals (hereafter PETA). Sunil Kr. Jain, Aneesh Mittal, Sachin Sharma, A.K. Soni, G. Sivabalamurugan, Anis Mohd, L.K. Pandey. Dr. Adish Agarwala appeared. 2. Respondents: A. Nagaraja and other 11 petitions from 2011 to 2014 clubbed together for whom Additional General, A. Mariarputham, Raj Panjwani were the council. In the appealed case, the son of the respondent who was a participant in the game was killed during the game due to sustaining many injuries on his body. Procedural facts: The 2006 and 2014 petition was initially filed in Madras High Court as a writ of Mandamus[2] under Art 226 and in 2007 the division bench consisting of Justices Elipe Dharma Rao and P.P.S. Janarthana Raja reversed the previous judgment against which several SLPs were filed in Supreme Court under Art.136[3], Art 133[4], Art 142[5] and Art. 32[6] and the bench headed by Justice K.S. Radhakrishnan granted the leave. Historical facts: Jallikattu of Tamil Nadu and Bullock cart racing of Maharashtra were being practiced for over 2500 and 450 years respectively. The term Jallikattu refers to silver or gold coins tied on the bulls’ horns. In Tamil Nadu, it is a sport played on the third day of Pongal. On this day a running bull is released into a crowd, where participants either, grab and ride on the bull to stop it, or take the flag attached in the bull’s horn[7]. The bulls which perform well in this game are used for breeding and they fetch a high price in the market. Similarly, rekla race of Maharashtra is organized after Makara Sankaranthi, on Chaitra astami. On this day various cart owners organize bullock cart race where bullock carts run miles and the winning team is rewarded. The roller coaster of the bull games controversy started in the year 2004 with the petition filed by the South Indian Humanitarian League and Blue Cross of India to the Petitions’ Committee of the TN state legislature to ban Jallikattu and other sports using bulls. Though the judgment of the said petitions held by Justice FM Ibrahim Kalifulla permitted the â€Å"sport† with a rider, that the bulls used in the game should be unharmed. In 2006 judgement held by Madras High Court by Justice R. Banumathi and Pinki Chandra Ghose, by expanding the scope on a writ of mandamus[8] filed against a police officer for willful omission in granting permission for the condonations filed by villagers seeking permission for conducting the game by Ramanathapuram Police the court along with dismissing the writ with reference to the 1996 judgement of Panaji Bench, Bombay High Court, banned conducting all games involving harsh training of animals like rekla race, oxen race and jallikattu. This strengthened the then PCA Act, 1960. Whereas in 2007 the division bench[9] consisting of Justices Elipe Dharma Rao and P.P.S. Janarthana Raja took a harmonious construction and enabled regulatory measures to ensure the safety of the animals instead of previous complete restriction, this order was later on overruled by three judges’ bench of Supreme Court. The apex court in 2008 granted permission for conducting rekla race by limiting the race field distance to 15m radius. The Tamil Nadu government then passed TNRJ Act to do away with this judgment, against which AWBI and PETA filed writ petition challenged in the Division Bench Judgment on the basis of PCA Act, MoEF Notification 2011. Another set of SLPs were filed again the Bombay High Court upholding the MoEF Notification 2011 and the corrigendum issued by the Government prohibiting exhibition and training of animal, of which A. Nagaraja father of a participant who died in the course of game and others, and AWBI and other animal welfare organisation working for the protection of the animals were parties, the court held the final judgement to ban both the games stating that these games as violation to S. 5 to S.11 of the PCA Act and fundamental duties, under Art 51A (g) and (h)[10] of the Constitution. Relief: The relief claimed by the parties were to clarify whether 1. the TNRJ Act was in repugnancy and in violation of PCA Act 1960, 2. Jallikatt and rekla race promotes cruelty in the name of culture 3. The Bombay High Court judgment was justified in upholding the 2011 notification of the central government. Arguments: From the judgment, the appellants argued on the basis of physical and mental cruelty faced by the bulls, repugnancy of the Act to PCA Act and many reports, affidavits and photographs from certified authorities, which talks about the animal behavior prior and after the game highlighting the cruelty over bulls during the games. It was also argued that TNRJ Act doesn’t have the effect of a law since the President has not asserted it. Furthermore forcing an animal to take part in such game was against Art.51A (g) and Art. 21[11] in addition to being in violation of S.3 and 11 of PCA Act. Organizers of Jallikattu and rekla race took a standby stating that the game was conducted during the days of the festival which is being practised for years and proper care has been taken by the committee members and the bull owners ensuring its safety and no cruelty as mentioned under S.11(1)(a) is meted out. It was further argued that the presence of collectors, doctors and police officials etc on duty ensures such cruelty doesn’t take place and also requested to regulate the event rather than stopping it. These apprehensions were meet by TNRJ Act. In addition to this, it was argued by the state that non-applicability of tickets for the event excludes them from being a part of S.22 of PCA Act. The matter of previous notifications of MoEF was also discussed with reference to N.R. Nair Others Vs U.O.I[12], where the court formed a committee to discuss the corrigendum of exclusion of dogs from the initial list whereas the same was not done at the present situation. The outcome of the case: The Special Leave petition was granted and the case was disposed of, setting aside the Madras High Court order of upholding the TNRJ Act, holding the Act unconstitutional and void, upheld the Bombay High Court judgment validating 2011 notification whereby bull was included in the list of animals prohibited from being exhibited and trained. Application: The judgement, in this case, strengthened the PCA Act, 1960 and elevated the rights of the animals to that of Art 21 and imposed Art 51 of the constitution as a strict obligation upon the citizens. It also held that spectators would also be hurt, since the requirement of 8 feet high barricades were not emulated and guaranteed rights under S.3 and 11 of PCA Act r/w Art.51A (g) (h) cannot be curtailed, unless as per S. 11(3) and 28 of PCA Act. Also recommended the state and other authorities to take reasonable steps to ensure the protection of the freedoms. The TNRJ Act 2009 was held violative to Art. 254(1). Analysis The judgment starts with a brief summary of the case followed by arguments and the holding. The decision of Supreme Court thought was appropriate there were alternative methods available which could have been much more harmonious in nature. The judgment might have strengthened the animal protection workers and raised the status of the animal right to the level of fundamental rights in the constitution. But it has also lead to public unrest in the state for three days which ended in the passing of an ordinance. The logical reasoning in the judgment was irrational and it was pleaded by the prosecutor that â€Å"if the court can grant permission for slaughtering animals for religious then why not grant permission to conduct a game which doesn’t possess any threat to their life†. Regarding the repugnancy nature of the tnrj act with respect to PCA act, 1960: It has to be noted that Entry 17[13] of List 3 guarantees the right to frame laws on the said subject to both State and Union government. Public health being a matter under State list have equal importance as ensuring public interest. Thus the Act which has a direct impact on the health and safety of the public cannot be encouraged. Art 19 (1) (g) has given the right to practice, profess and carry any occupation trade or business and also forbids to force any citizen to practice profession hence the State cannot force the citizen to engage in non-profit trade in the name of Agriculture. Though banning the sports could end the physical and mental torments faced by the bulls it could also affect in the slaughtering of them and leads to their extinction. This is against the Biodiversity Act 2002. The Court laid down the aspects of Article 51-A (g) and (h), Fundamental Duties on the part of the citizens and extended the scope of Art. 21 to the animals. It is indeed a ‘dangerous sport’. Considering the number of people being injured and died and the cruelty and harassment faced.
